1. Acceptance of Terms

By accessing or using DreamStorm ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

DreamStorm is a spiritual insight platform that generates personalized reports based on various spiritual and metaphysical systems including:

  • Western Astrology (Sun, Moon, Rising signs)
  • Human Design charts and analysis
  • Gene Keys Activation Sequence
  • Numerology (Life Path and Destiny numbers)
  • Mayan Tzolkin and Galactic Signature
  • Chinese Zodiac
  • Tarot birth cards
  • MBTI and Enneagram personality analysis
  • Etymology and name analysis
  • DreamStorm: AI-powered meditation generation from your dreams and goals

3. User Accounts and Data

3.1 Account Creation

To access certain features, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Required Information

To generate your spiritual insights, we require:

  • Essential: Full name, birth date
  • Enhanced accuracy: Birth time, birth location
  • Optional: MBTI type, Enneagram type

3.3 Accuracy of Information

You represent that all information provided is accurate and complete. Inaccurate birth data may result in incorrect spiritual calculations and insights.

4. Service Limitations and Disclaimers

4.1 Entertainment and Educational Purpose

DreamStorm is provided for entertainment, self-reflection, and educational purposes only. Our insights are not a substitute for professional advice in areas including but not limited to:

  • Medical or mental health treatment
  • Financial or investment decisions
  • Legal matters
  • Relationship counseling
  • Career or business guidance

4.2 AI-Generated Content

Our platform uses artificial intelligence to generate personalized interpretations. While we strive for meaningful insights, AI-generated content may contain inaccuracies, biases, or generic statements. Use your own judgment when interpreting results.

4.3 Third-Party APIs

We rely on external services for calculations including astrology APIs, geocoding services, and Human Design APIs. Service availability and accuracy depend on these third-party providers.

5. Payment Terms

5.1 Premium Features

Some features require payment processed through Stripe. By purchasing premium access, you agree to pay all applicable fees and taxes.

5.2 No Refunds Policy

All sales are final. Due to the digital nature of our service and immediate delivery of personalized content, we do not offer refunds, returns, or exchanges. No refunds will be provided for any reason, except as required by applicable law or in cases of technical errors on our part.

6. User-Generated Content and Intellectual Property

6.1 Your Content Rights

You retain all ownership rights to content you create or upload to DreamStorm, including:

  • Written dream descriptions and goals
  • Uploaded photos and images
  • Voice recordings for DreamStorm voice cloning
  • Personal information and profile data

6.2 License Grant to DreamStorm

By submitting content to our Service, you grant DreamStorm a limited, non-exclusive, worldwide, royalty-free license to:

  • Store your content securely on our servers and third-party cloud storage (Supabase)
  • Process your content through AI services to generate personalized insights (meditation scripts, enhanced images, voice cloning)
  • Display your content back to you within the Service
  • Create derivative works based on your content (e.g., meditation audio from your voice)

📜 License Limitations

  • Scope: This license is strictly limited to operating and providing the Service
  • No Resale: We will never sell, license, or share your content with third parties for their commercial purposes
  • No Public Display: Your content is private and not displayed to other users (except as you explicitly choose to share)
  • Revocable: This license ends when you delete content or terminate your account

6.3 AI-Generated Content Ownership

Content generated by AI based on your inputs (meditation scripts, enhanced images, narrated audio) is:

  • Accessible to you: You can download, view, and use AI-generated content for personal, non-commercial purposes
  • Not exclusively yours: AI may generate similar content for other users with similar inputs
  • Subject to AI service terms: Cartesia, Replicate, and other AI providers retain certain rights per their terms
  • No commercial use: You may not sell, distribute, or commercially exploit AI-generated content without explicit permission

Example: If you record your voice and generate a meditation, you may listen to it privately, but you cannot sell recordings of the meditation to others.

6.4 Content Representations and Warranties

By submitting content, you represent and warrant that:

  • You own all rights to the content OR have obtained all necessary permissions
  • Content does not violate any copyright, trademark, privacy, or other third-party rights
  • Content is not illegal, defamatory, obscene, or harmful
  • If uploading images of people, you have obtained consent from all individuals depicted
  • If recording a voice, it is YOUR voice (not impersonating someone else)

6.5 Prohibited Content

You may NOT upload or submit:

  • Copyrighted images, videos, or audio you do not own
  • Voice recordings of other people without written consent (illegal in many jurisdictions)
  • Content depicting minors (under 18 years old)
  • Illegal, harmful, violent, or sexually explicit content
  • Content containing personal information of third parties (addresses, SSNs, etc.)
  • Content that violates third-party AI service policies (Cartesia, Replicate)

⚠️ Violation Consequences

  • Immediate removal of violating content
  • Suspension or termination of your account
  • Reporting to law enforcement if content is illegal
  • Potential legal liability to affected third parties

6.6 Content Moderation and Removal

We reserve the right to:

  • Review content for policy compliance (human or automated review)
  • Remove content that violates these Terms
  • Disable features if you repeatedly violate content policies
  • Report illegal content to authorities

We are not obligated to monitor all user content but may do so at our discretion.

6.7 Content Deletion and Account Termination

Your Deletion Rights:

  • Delete individual meditations, images, or dreams at any time
  • Delete your voice profile from Settings → DreamStorm → Voice Profile
  • Request full account deletion, which will delete all content within 30 days

Deletion Timeline:

  • Meditation audio: Deleted from storage within 30 days
  • Voice profiles: Deleted from Cartesia within 30 days
  • Uploaded images: Deleted from storage within 30 days
  • Dream text: Deleted from database immediately
  • Backup copies: May persist for up to 90 days for disaster recovery

Termination by Us:

If we terminate your account for Terms violations:

  • You lose immediate access to all content
  • We may retain content for legal/compliance purposes (e.g., fraud investigation)
  • You may request a data export within 14 days of termination (subject to approval)

6.8 Data Portability

You may download your content at any time:

  • Meditation audio: MP3 files via meditation library
  • Dream images: WebP/PNG files via image export
  • Dream descriptions: JSON export via Settings → Export Data
  • Voice profile metadata: Available in Settings (voice audio not retained after processing)

We provide data in common formats to facilitate portability to other services.

6.9 Feedback and Suggestions

Any feedback, suggestions, or ideas you provide about DreamStorm:

  • Are provided voluntarily without compensation
  • May be used by us to improve the Service
  • Do not grant you any ownership rights to improvements we make based on your feedback
  • Are non-confidential (do not submit confidential information as feedback)

7. AI Vision Board Feature Terms

7.1 Voice Cloning Feature

🎙️ Voice Cloning Requirements

  • Voice cloning requires a 1-5 second audio recording
  • Voice recordings are processed by Cartesia, a third-party AI service
  • Voice profiles are stored until you delete them
  • You must have legal rights to clone the voice (i.e., it must be YOUR voice)
  • Impersonating others' voices without consent is prohibited and illegal

⚖️ Legal Consequences of Voice Impersonation

Cloning another person's voice without their explicit written consent may result in:

  • Civil liability - including damages for identity theft, fraud, emotional distress, and violation of personality rights under state and federal law
  • Criminal penalties - including charges for fraud, identity theft, wire fraud, and violations of state impersonation laws (varies by jurisdiction)
  • Regulatory enforcement - violations of biometric privacy laws (e.g., Illinois BIPA) may result in statutory damages of $1,000-$5,000 per violation
  • Immediate account termination - we will terminate your account and cooperate with law enforcement investigations
  • Legal cooperation - we will provide user information to law enforcement and affected parties pursuant to valid legal process

By using the voice cloning feature, you acknowledge that you have read and understand these consequences and agree to clone only your own voice or voices for which you have explicit written consent.

7.2 Image Upload and Processing

  • Maximum file size: 8 MB per image
  • Supported formats: PNG, JPEG, WebP, GIF, BMP
  • Images are processed through third-party AI services (Replicate)
  • You represent that you own all rights to uploaded images
  • Images containing identifiable persons require consent from those persons

7.3 AI Generation Limitations

  • AI-generated content is provided "as-is" without warranties
  • We do not control AI service availability or quality
  • AI services may refuse requests for policy violations
  • Generated content may be similar across users (AI is not unique)

7.4 Video Generation (Beta)

  • Video generation is a beta feature with limited availability
  • Free users: 1 video total (first dream only)
  • Pro users: 20 videos per month
  • Videos are 5-10 seconds in length
  • Video processing may take up to 2 minutes

7.5 Usage Limits

Free Tier

  • 3 dreams total (lifetime)
  • 3 meditations total (lifetime)
  • 1 video total

Pro Tier

  • Unlimited dreams
  • 50 meditations per month
  • 20 videos per month
  • Unlimited image upscaling

8. Third-Party Services and APIs

8.1 Service Dependencies

DreamStorm relies on third-party AI services that may:

  • Change their terms or pricing without notice
  • Experience downtime or service interruptions
  • Refuse to process certain content
  • Discontinue services entirely

Important: We are not responsible for third-party service failures or changes to their terms.

8.2 Third-Party Terms

By using DreamStorm, you agree to comply with:

  • Cartesia Terms of Service (voice cloning)
  • Replicate Terms of Service (image/video processing)
  • Cerebras/OpenRouter Terms (AI text generation)

Violations of third-party terms may result in feature restrictions.

8.3 Data Processing Agreements

We maintain data processing agreements with:

  • Cartesia (voice processing)
  • Replicate (image/video processing)
  • Supabase (data storage)

These agreements ensure GDPR and privacy compliance.

9. Intellectual Property

The Service, including all content, features, and functionality (excluding user-generated content), is owned by DreamStorm and protected by copyright, trademark, and other intellectual property laws. Your generated reports are for your personal use only.

10. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose or commercial exploitation
  • Attempt to reverse engineer or extract our algorithms
  • Create multiple accounts to circumvent usage limits
  • Share, redistribute, or resell your personalized reports
  • Use automated systems to access the Service beyond normal usage
  • Provide false or misleading birth information
  • Clone voices of other people without explicit written consent
  • Upload copyrighted images or content you don't own
  • Use DreamStorm to create harmful, illegal, or offensive content

11. Rate Limiting and Fair Use

To ensure service availability for all users, we implement rate limiting on API requests. Excessive usage may result in temporary or permanent account suspension. AI vision board features have specific usage limits based on your subscription tier (see Section 7.5).

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMIC BLUEPRINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING AI VISION BOARD FEATURES, AI-GENERATED CONTENT, VOICE CLONING, OR THIRD-PARTY SERVICE FAILURES.

13. Indemnification

You agree to indemnify and hold harmless DreamStorm from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights through your user-generated content.

14. Termination

14.1 Account Deletion by You

Upon account deletion:

  • All meditation audio deleted within 30 days
  • Voice profiles deleted from Cartesia within 30 days
  • Uploaded images deleted from storage within 30 days
  • Dream descriptions and metadata deleted immediately
  • Backup copies may persist for up to 90 days

14.2 Service Termination by Us

We may terminate accounts for:

  • Violations of these Terms
  • Uploading prohibited content
  • Fraudulent activity
  • Abuse of AI services
  • Impersonating others through voice cloning

Upon termination, you lose access to all generated content.

14.3 Right to Download

Before deletion, you may download:

  • Meditation audio files (MP3)
  • Generated images (WebP/PNG)
  • Dream descriptions (JSON export)

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or prominent notice on the Service. Continued use constitutes acceptance of modified Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where DreamStorm operates, without regard to conflict of law provisions.
